Age Discrimination
  • Age discrimination in employment results when someone is released from a job in order for the employer to hire a younger (usually less expensive) employee.

  • Age discrimination in employment applies only to people who are over the age of 40.

  • There is no upper age limit on those to which it applies.
Americans with Disabilities Act
  • The Americans with Disabilites Act requires employers to make reasonable accomodations in order for qualified individuals with disabilites to be able to perform a specific job.

  • It is the responsibility of the employee or applicant to request an accommodation.

  • Determinations of disabilities and reasonableness are all situation specific.
Family and Medical Leave Act
  • The Family and Medical Leave Act applies to all qualified employees.

  • Determination of whether an employee is qualified is based on years of employment and whether or not they are full time.

  • A determination of whether the leave would create a hardship for the employer is made at the time of the first request.
