Discrimination -  To treat people differently based upon a characteristic or belief they may have or hold

 

Harassment – Verbal, physical or written behavior which is directed toward or against an individual and which serves to intimidate, interfere with or threaten the designated person.

 

Sexual HarassmentUnwelcome conduct of a sexual nature which affects a person’s ability to do their job.

 

Hostile EnvironmentUnwelcome conduct of a sexual nature resulting in an atmosphere so uncomfortable it prevents a person from effectively doing their job.

 

Disabled Person – One who has a physical or mental impairment that substantially limits one or more of his or her major life activities and has a record of such impairment or is believed to have such an impairment.

 

Constructive discharge – Decision by an employer of such a nature that the only choice an employee is given is to accept the situation or resign.

 

Reasonable Accommodations – The definition of what is reasonable is dependant upon circumstances related to both the disabled person and the employer.  It can include anything from a modified work schedule to making facilities accessible.

 

Undue Burden – Employers are not required to take actions that would require significant difficulty or expense.  This is dependent on the nature and cost of the accommodation, the overall financial resources of the employer, and the type of operation.

 

Strict Liability – liability without fault

 

Reasonable Person – an objective and conscientious person in the same or similar circumstances
