Traffic
and Parking Regulations
2007-2008
INTRODUCTION
- By the authority vested in the Kansas Board of Regents through
the provision of Kansas Statutes 74-3209 - 74-3216, regulations
pertaining to the operation and parking of vehicles are hereby
established and set forth.
Students, Faculty, Staff, Visitors,
as well as Endowment Association Affiliates are expected to
be familiar with and abide by these regulations. The vehicle
operator is responsible for knowing all applicable laws and
regulations.
The Fort Hays State University parking
system receives no direct funding from the State of Kansas;
therefore, a system of service charges for motor vehicles
utilizing University parking facilities is mandatory to maintain
those facilities.
SPEED
LIMITS - Speed limits on campus streets are 20 miles
per hour and 15 miles per hour in parking lots.
PARKING
PERMITS - Appropriate parking permits are required for
all motorized vehicles parked on Campus during the University
term. A permit does not guarantee the holder a parking space,
but only an opportunity to park within a specified zone or
zones. Parking permits are not required in the visitor stalls,
15- and 30-minute stalls, and the parking meter stalls
Parking permits may be
purchased annually or by the semester. If purchased annually,
permits will be valid for the entire year (August 1 to July
31). Permits that are purchased for the spring semester
are also valid for the summer session (January 1 to July 31).
Parking permits issued
by the Endowment Association authorize the permit holder to
park in visitor, staff or student parking stalls. The annual
Endowment permit, valid from August through July, may be used
by the recipient and spouse ONLY.
Salespople, repair technicians,
or other individuals who frequently provide services to the
University are required to display a Special Service permit.
Special Service parking permits are issued at the discretion
of the University. (Contact the University Police Department
for more information.)
Upon request, individuals
holding a valid parking permit will be issued an additional
parking permit for a second vehicle at no extra charge if
the original permit type is not compatible for the second
vehicle. (Example: motorcycles, convertibles, or vehicles
that cannot be locked.)
Persons living in University
housing may request a parking permit for more than one vehicle
through the Traffic Committee.
Temporary parking
permits will be issued at the discretion of the University
Police to current permit holders who are unable to properly
display their original permits.

PERMIT
OWNERSHIP - A parking permit will be issued to an INDIVIDUAL,
not a vehicle, and grants the privilege of parking on University
property by the permit holder and spouse. Ownership of the
permit remains with the University. The permit holder may
register more than one vehicle in which the permit may be
displayed. Failure to register a vehicle will subject the
permit holder to fines.
A registered vehicle may
be parked on campus by any person holding a valid permit identical
to the permit (Faculty/Staff, Zone 1 or 2, etc.) displayed
in the vehicle regardless of vehicle's ownership. Use of a
FHSU permit by a person not holding a permit or a person holding
a permit different from that displayed in the vehicle being
parked on campus will subject the permit holder and user to
fines. (See FINES, paragraph 3.)
Vehicles owned and registered
by residents of University housing (residence halls and/or
Wooster Place apartments) may be parked on streets or in lots
adjacent to the residence halls or Wooster Place apartments
by persons other than those to whom the parking permit is
issued.
DRIVER
RESPONSIBILITY - Except when reported lost or stolen,
the person to whom the permit is issued will be responsible
for, and subject to, any fines for violations on the permit;
although the person operating the vehicle may also be held
responsible at the discretion of the Traffic Committee.
The responsibility of
finding an authorized parking space rests with the driver.
Lack of parking space, mechanical problems, inclement weather
conditions or other disabilities are not considered valid
reasons for violation of traffic and parking regulations.

FACULTY/STAFF
- To park a vehicle on campus, faculty and staff must purchase
a Faculty/Staff permit or a Zone 1 parking permit, and must
properly display this permit between 7 a.m. and 4 p.m. weekdays
(except where otherwise posted).
Faculty/Staff parking
permits allow parking in any unrestricted stall on campus.
Zone 1 parking permits allow parking in a Zone 1, Zone 2 or
Zone 3 stall.
PARKING
AREAS (See Map)
- ZONE 1 includes the area bounded by a line on the east by
Park Street (both sides of the street); on the north by North
Campus Drive (both sides of the street); on the west by College
Drive (both sides of the street) including parking Lots A-1,
A-2 and the Maintenance area; on the south by the junction
of Lyman Drive and Agnew Lane, including South Campus Drive
(both sides of the street), as well as Lot D.
ZONE 2 includes Residential Life areas (Lyman
Drive south from Agnew Lane, Dwight Drive, Custer Drive and
any other marked or unmarked streets west of, and including,
Lewis Drive, the parking lots of Wooster Place apartments,
Custer, Agnew, Wiest, and McMindes halls), Elm Street, Lewis
Field, Hays Area Children's Center (HACC), and Lots E, J,
L and M. Parking regulations will be in effect on a 24-hour
basis, excluding Elm Street, Lewis Field dirt lots, HACC,
and Lot L and M parking areas (which are enforced from 8 a.m.
to 2:30 p.m. weekdays).
ZONE 3 includes Lot K
(north of Gross Memorial Coliseum).Parking is prohibited
on Agnew Lane and Gustad Drive. Parking in the delivery areas
and loading zones is limited to 30 minutes. Use of the yellow-marked
areas at Custer, McMindes, Wiest and Agnew halls for loading
and unloading is permitted between 4 p.m. and 6 a.m. for a
maximum duration of 30 minutes.

ZONE 1 - ZONE 1 parking
permits are required for both vehicles and motorcycles to
park on College Drive, North Campus, South Campus, Park Street
and Lyman Drive north of the junction with Agnew Lane between
7 a.m. and 4 p.m. weekdays.
ZONE 1 parking permits
are required to park in Lots A-1, A-2, and D between 8 a.m.
and 2:30 p.m. weekdays.
ZONE 1 parking permits
are valid in ZONES 2 and 3.
A holder of a Zone
1 parking permit who moves into the Restricted Area
must surrender the permit to the University Police. Failure
to do so within 14 calendar days is a violation. (See FINES,
paragraph 3)
ZONE 2 - ZONE 2 parking
permits are required for both vehicles and motorcycles to
park in Lots L and M between 8 a.m. and 2:30 p.m. weekdays.
Students residing in the
residence halls can aply & receive their permit by completing
the vehicle registration form in the computer lab, and then
going to the front desk & asking for the parking permit.
Payment for the permit is due to the University Police office
within 14 days of the date on the application, or the vehicle
will be towed at the owner's expense if found parked on campus
and the account will be turned over for collection. Late fees
& any other reasonable collection costs may be charged
to the student. Students with outstanding charges may be unable
to enroll for future semesters & to access academic records.
WOOSTER-ZONE 2 parking
permits are required when parking in stalls marked WOOSTER.
One WOOSTER-ZONE 2 permit will be issued per apartment. Wooster
residents with additional vehicles may purchase regular ZONE
2 permits.
ZONE 2 parking permits
are required to park in the Residential Life area, Lots E
and J and are enforced on a 24-hour basis.
ZONE 2 parking permits
are valid in ZONE 3, but are NOT valid in ZONE 1.
ZONE 3 - ZONE 3 parking permits
are required to park in Lot K between 8 a.m. and 2:30 p.m.
weekdays.
RESTRICTED
AREA (See Map)
- Restricted Area includes the area bounded by a line on the
east by Fort Street (includes both sides of street), on the
north by West 12th Street (includes both sides of street as
well as the West 12th Street Mobile Park), and on the west
and south by U.S. 183 Alternate.
EMERGENCY
SNOW POLICY - The following emergency snow parking policy
will be enacted when snow and ice covers curb markings and
will remain in effect until the streets and parking areas
return to normal.
Except where signs are
posted, all parking stalls facing toward the quadrangle, curb
parking adjacent to the west side of Malloy Hall, curb parking
adjacent to the east side of Tomanek Hall, curb parking adjacent
to the east and west sides of Cunningham Hall, Lots B, C,
and the Maintenance Area will be designated as Staff ONLY
from 7 a.m. to 4 p.m. (Staff parking in the Residential Life
areas - Zone 2 - is marked with signs and will not be affected
by snow and ice.) All other parking stalls on roadways around
the quadrangle and Lyman Drive south to Agnew Drive will be
designated as Zone 1 from 7 a.m. to 4 p.m.
Zone 1 parking permits
will be required to park in Lots A-1, A-2, and D between 8
a.m. and 2:30 p.m. weekdays.
In restricted zones (marked
with yellow paint), the common sense rule will be in effect.
Parking which interferes with normal and reasonable flow of
pedestrian and/or vehicle traffic will be considered a violation
and will be subject to fines and/or towing.

PARKING
METERS - Parking meters are located on South Campus Drive
in front of the Forsyth Library (enforced 7 a.m. to 4 p.m.
weekdays) and in Lot A-2 (enforced 8 a.m. to 2:30 p.m. weekdays).
Anyone may use metered stalls by paying rate posted on
the meter.
ENFORCEMENT
- Failure of the university to strictly enforce any parking
regulations shall not be construed as a waiver for the future
enforcement of the regulations.
The University Police
Department reserves the right to hire students to enforce
parking regulations and write parking tickets on University
property.
PARKING
PERMIT FEE SCHEDULE - Student parking costs are partially
included in student fees. Students are assessed a parking
fee of 50 cents per credit hour. The following permit fees
shall be charged for Faculty/Staff, Zone 1, and Zone 2 parking
permits.

- Refunds: After
the first day of classes, a refund for parking permit will
only be considered by appeal.
- *Faculty/Staff are also eligible to purchase
a Zone 1 parking permit- $60 annual; $35 semester; $10 summer.
- **$5 to park on campus
if enrolled in a class scheduled for a week or less; $10
for complete summer semester.

PLACEMENT
& DISPLAY OF PARKING PERMITS - All hanging parking
permits must be displayed from the interior rearview mirror.
Items that obstruct the view of the current FHSU permit will be considered an improper display violation. (Individuals
using sun protectors need to display the permit nearest windshield.)
Adhesive permits (issued for vehicles without an interior
rearview mirror, etc.) are to be attached to the outside lower
left corner of the rear glass. Adhesive cycle permits are
to be attached to the left front fork. There will be no
exception as to the placement of permits unless
granted by the University Police Department.
Displaying two parking
permits of the same type (hanging or adhesive) shall be considered
a violation. A valid hanging permit shall take precedence
over all other parking permits.
A lost or stolen permit
must be reported to the University Police to relieve the purchaser
of any further responsibility. Replacements will be sold for
$5.
CYCLES - Operators
of motorcycles and mopeds with Cycle license plates
are required to purchase a cycle parking permit to park on
campus. Valid zoning regulations also apply to motorcycles.
Cycles must park in parking stalls designated for cycles -
not in bicycle racks or vehicle stalls.
BICYCLES
- No parking permit is required to ride bicycles or to use
bicycle racks provided on Campus. For security purposes, bicycles
may be registered, free of charge, with the University Police.
Registration cards may be obtained at the Main Desk of McMindes,
Agnew and Wiest halls, or at the University Police Department
Office. Kansas Statute 8-1587 states that "Every person riding
a bicycle upon a roadway shall be granted all of the rights
and shall be subject to all of the duties applicable to the
driver of a vehicle."
VISITOR
PARKING - Any person who is not currently enrolled
or employed at the University may park in areas designated
for visitor parking, 15- and 30-minute stalls, meter parking
stalls or obtain a visitor permit from the University Police
Department.
Visitors parking on Campus
are required to observe the rules and regulations regarding
restricted areas, staff parking stalls, yellow zones, etc.
Permits are only valid when hung from the interior rearview
mirror.
Visitors receiving
five or more violations will be subject to tow-off at the
OWNER'S EXPENSE.
PEDESTRIANS
- The driver of any vehicle shall yield the right-of-way
to any pedestrians crossing the roadway at a marked or unmarked
crosswalk, or at an intersection.

EMERGENCY PARKING
- In case of illness or vehicle repair, which must be done
immediately, emergency parking is permitted except in front
of fire hydrants. However, the University Police Department
must be informed of the emergency as soon as practical.
(see VIOLATION #11)
HANDICAP
STALLS - A vehicle displaying a disabled tag or placard
may be parked in any handicap stall. Handicapped faculty,
staff and students are also required to display an appropriate
Fort Hays State parking permit nearest the windshield.
A person with a temporary disability (who presents written
verification from a doctor) should contact the University
Police Department for consideration of a temporary Zone 1
permit which may be issued for a maximum of 60 days.
MOVING VIOLATIONS
- Moving violations are subject to the "Uniform Act Regarding
Traffic on Highways" as defined in Sections 8-1401 - 8-2306
of the General Statutes of the KSA '05 Supplement, or the
Standard Traffic Ordinance for Kansas Cities.
Violators of the Uniform
Traffic Act will be issued a summons into the Ellis County
District Court. Violators of the Standard Traffic Ordinance
for Kansas cities will appear in the Hays Municipal Court.
SIGNS,
SIGNALS & MARKINGS - Any signs, signals or markings (painted
or otherwise) controlling the movement or parking of motor
vehicles on Fort Hays State University campus will be under
the jurisdiction of the University Police Department.
VIOLATIONS
- Tickets will be written for violations beginning the
first day of classes each semester.
- Parked without a current, valid parking permit
during the hours stated in the current parking regulations.
- Parking permit improperly displayed. (See
PLACEMENT & DISPLAY OF PARKING PERMITS)
- Display of two or more parking permits of
the same type.
- Use of an illegal or altered parking permit.
(See Fines, paragraph 3)
- Failure to surrender parking permit to the
University Police Department after moving into Restricted
Area.
- Backed into a parking stall. (Front bumper
must face curb.)
- Overtime parking in 15- or 30-minute stall,
parking meter stall, or any other zone with a time limit.
- Parked in a Visitor stall by those other
than bona-fide visitors (see Visitor Parking) to the campus.
- Motorcycles and mopeds parked in stall other
than a stall marked Cycle.
- Failure to remove an inoperable or abandoned
vehicle parked on campus within 48 hours of receiving notification
shall subject the owner to a citation and the expense for
vehicle removal.
- Parked in any area designated by signs or
other markings as being unlawful.
- Parked on pedestrian walks, grass or grounds
not assigned for parking, or blocking curb cuts for the
handicapped.
- Parked on or obstructing the traffic lanes
of any road, street or driveway on campus.
- Parked so that a parking stall marker, or
its extension into the street, passes under any part of
the parked vehicle.
- Operation of an unauthorized motor vehicle
(including motor scooters, mopeds, motorcycles) on campus
sidewalks.
- Parked on the right-of-way between the campus
and Highway 40.
- *Four (4) unpaid
fines, will subject vehicles to tow-off at OWNER'S EXPENSE.

FINES
- Parking in a handicap stall will be a $75 fine -NO
WARNING.
The first parking violation
of each semester may warrant a warning ticket or a fine. Parking
without a valid permit will draw a fine of $35. All other
violations will warrant a $10 fine.
Any person (faculty, staff,
student or patron) found guilty of violating parking regulations,
sharing a permit or loaning a permit to a non-authorized user,
possessing an illegal or altered parking permit or assisting
another person in securing an illegal permit, may be assessed
up to a $50 fine by the Traffic Committee.
The Traffic Committee
shall also have the power to recommend disciplinary action
against parking violators to the Office of the Vice President
for Student Affairs.
All fines incurred
by students are payable at the Student Fiscal Services office
located in Sheridan Hall 110-G. Failure to pay your fines
may result in your inability to enroll and inability to access
academic records. In addition, all reasonable collection costs,
including attorney fees and other charges necessary for collection
of any amount not paid when due, will be charged to the student.
A $25.00 administrative fee is assessed each time a payment
due date has been missed until the balance has been satisfied. All
fines incurred by faculty/staff are payable at the University
Police Department located in Brooks Building 112.
Any motor vehicle
operator who receives five or more violations, with four carrying
fines, will be notified by certified mail to pay fines within
14 days from the date of the letter. Failure to pay fines
withing the 14-day period will result in his/her vehicle being
towed-off at the OWNER'S EXPENSE if found parked on campus.
If a student has any fines, which have not been paid, he/she
will not be allowed to re-enroll, graduate, or transfer records
A parking permit for
the current period will not be issued if the applicant has
any unpaid parking fines.
Vehicles may be removed
from campus streets, drives, zones, lawns or parking areas
if allowed to stand in violation of campus regulations or
state laws governing vehicles. The owner of the vehicle will
pay tow-off costs.
Abandoned property
will be sold if not claimed and removed.
APPEALS
- The Traffic Committee shall have immediate jurisdiction
over all issues dealing with campus parking, and shall have
the power to assess fines as deemed necessary. The Traffic
Committee is composed of students, staff and faculty, and
is a part of the judiciary branch of the Student Government
Association.
Appeals must be made
to the Chairman of the Traffic Committee, 628-5328 or www.fhsu.edu/police,
within 14 calendar days of the violation. After filing
the written statement, an appellant may also make a personal
appearance before the Traffic Committee.
Failure to appeal within
the above time period is considered prima facie evidence that
the violation will not be appealed.
ACCIDENTS
- Any accident involving a vehicle on campus must be reported
to the University Police (628-5304) at once. (Evenings and
weekends, call the Hays Police Department at 625-1011they
will contact the officer on duty at Fort Hays.)
