Drug-Free Workplace
It is the policy of FHSU that the unlawful manufacture,
distribution, dispensing, possession, or use of controlled substances
is prohibited in its workplace. Any full or part-time officer or
employee of the University, including faculty, other unclassified
staff, classified staff, and student employees, found to be illegally
manufacturing, distributing, dispensing, possessing, or using controlled
substances at the workplace of the University regardless of the
site of the workplace, shall be subject to disciplinary action in
accordance with applicable policies of the State of Kansas, the
Board of Regents, and FHSU. Officers and employees are reminded
that illegal manufacture, distribution, dispensing, possession,
or use of controlled substances may also subject individuals to
criminal prosecution.
As a condition of employment, all employees of FHSU
shall abide by the terms of this policy statement and will notify
FHSU of any criminal drug statute conviction for a violation occurring
in the workplace no later than five (5) days after
such conviction. For purposes of this policy, "conviction"
means a finding of guilt (including a plea of nolo contendere) or
imposition of sentence, or both, by any judicial body charged with
the responsibility to determine violations of the federal or state
criminal drug statutes.
The term "controlled substances" as used
in this policy means those substances included in Schedules I through
V of section 202 of the Controlled Substances Act and as further
defined by regulation at 21 CFR 1300.11 through 1300.15 (a listing
of controlled substances will be maintained in the campus personnel
office and at other appropriate locations on campus). The term does
not include the use of a controlled substance pursuant to a valid
prescription or other uses authorized by law.
This policy statement is an integral part of FHSU's drug-free awareness
program. This policy shall be given to all affected employees.
Employee Substance Abuse Prevention Programs
FHSU provides prevention and early intervention programs
which are intended to serve both the student population and employees.
These programs are administered under the direction of the University
Director of Substance Abuse Prevention and Wellness Programs in
the Division of Student Personnel Services.
The FHSU/Hays city community Alcohol and Drug Abuse
Prevention Team (ADAPT) functions as a planning/advisory group to
the director. Included in ADAPT are health care professionals, substance
abuse specialists, law enforcement officials, classified and unclassified
employees, and students.
Research indicates that prevention programs are most
effective when conducted frequently over a period of time. Therefore,
prevention programs are carried out several times during the year.
Examples of these programs are:
August - Orientation
October - National Collegiate Alcohol Awareness Week
December - Great Safe Holiday Break
February - National Collegiate Drug Awareness Week
March - Safebreak
April - Springwell
A designated driver program implemented by BACCHUS
(Boost Alcohol Consciousness Concerning the Health of University
Students) provides an awareness program for local bars and restaurants.
This program is a direct benefit to employees.
The Student Health Center, the Personnel Office, and
the Kelly Center are other resources available to all employees
for drug awareness and substance abuse counseling, information and/or
programs. In addition, the State of Kansas offers a toll-free number
for all state employees wishing to participate in the state Employee
Assistance Program. This number is 1-800-284-7575.
Employees are encouraged to use any of these resources
to assure a drug-free environment and workplace.
Procedures which will be Followed in the Event
an Employee is Convicted of Criminal Drug Statute Violations which
Occur in the Workplace
In accordance with FHSU disciplinary policies and
practices, when an employee is found to be in violation of the Drug-Free
Workplace Statement of FHSU, he/she may be subject to penalties
up to and including termination. Employees may also be required
to satisfactorily participate, at their expense, in a drug abuse
assistance or rehabilitation program before being allowed to return
to work. Appropriate action will be taken within thirty
(30) days of FHSU's notice of a conviction or violation
of the University's statement on a drug-free workplace.
