Commitment to Unbiased Law Enforcement - Racial or Other Biased-Based Policing Prohibited
It is the policy of the Fort Hays State University Police Department (FHSUPD) to treat all persons having contact with this agency in a fair, equitable and objective manner, in accordance with the law and without consideration of their race, color, religion, national origin or other individual characteristics. The University Police commissioned officers are prohibited from initiating law enforcement action against any person based solely on a person's race, ethnic background, gender, sexual orientation or religion.
Kansas law (K.S.A. 22-4606 through K.S.A. 22-4611) prohibits the practice of racial or other biased-based policing by any law enforcement officer.
"Racial or Other Biased-Based Policing" means the unreasonable use of race, ethnicity, national origin, gender, or religion by an agent in deciding to initiate an enforcement action. It is not racial or other biased-based policing when race, ethnicity, national origin, gender, or religion is used in combination with other identifying factors as part of a specific individual description to initiate an enforcement action.
If you believe that you have been the subject of racial or other biased-based policing by an police officer of the University Police Department, you may make a complaint to either the Fort Hays State University Police Department office at the Center of Public Safety, or the Kansas Attorney General's Office.
Any complaint alleging racial profiling or biased-based policing made against a police officer of the FHSUPD, should be made in writing, and directed to the Director of Police and Security at the Center of Public Safety. The complaint should describe in detail, the incident giving rise to the complaint. The complaint must be signed and include the name, address, phone number or other contact information for the person who was the subject of the law enforcement action. All complaints alleging racial profiling or biased-based policing on the part of a Fort Hays State University Police Officer will be thoroughly and aggressively investigated. Violations of FHSUPD policy prohibiting racial profiling or biased-based policing will result in disciplinary action against the involved officer(s).
