Introduction
By the authority vested in the Kansas Board of Regents through the provision of Kansas Statutes 74-3209 - 74-3216, regulations pertaining to the operation and parking of vehicles are hereby established and set forth. Students, faculty, staff, and visitors, as well as Foundation Affiliates, are expected to be familiar with and abide by these regulations. The vehicle operator is responsible for knowing all applicable laws and regulations. The Fort Hays State University parking system receives no direct funding from the State of Kansas; therefore, a system of service charges for all motor vehicles utilizing University parking facilities is necessary to maintain those facilities.
University Liability
Fort Hays State University (FHSU), the Fort Hays State University Police Department (University Police Department), and its constituents assume no duty for the care or protection of vehicles or their contents while the vehicle is on property owned, leased, or otherwise controlled by FHSU. Any failure of FHSU or the University Police Department to strictly enforce any parking regulation shall not be construed as a waiver for the future enforcement of regulations.
Authority
As established by FHSU policy and current practice, the University Parking Committee will adopt and enforce rules and policies governing the issuance of permits, allocation of parking space, fees, appeals, and the parking of vehicles upon the roads, streets, driveways, and parking facilities of the institution as granted by Kansas Statute. Parking privileges may be modified or pre-empted by authority of the President of the University. The Director of the University Police Department may alter, suspend, or modify parking regulations, fines, and/or fees as necessary to promote public safety or enhancement of the University, subject to review by the V.P. of Administration and Finance.
General Requirements and Provisions
- Definition of Parking: Any stoppage with intent of permitting a vehicle to remain standing, whether occupied or not.
- Parking permits are required for all motorized vehicles (including mopeds) parked on the main campus during the University term, with the exception of government owned vehicles with State of Kansas Official, County, Municipal, or School District tags and Emergency Vehicles. Times requiring parking permits are defined within these regulations and include Zone 1, Zone 2 and Restricted Parking stalls. A permit does not guarantee the holder a parking space but grants permission to park within a specified Zone or Restricted Parking Stall.
- Parking permits are not required for auxiliary FHSU campus areas, including the University Farm, Rodeo Grounds, Pavilion, Sternberg Museum, Foundation/Alumni Center, Soccer Stadium, Track and Field Facility, and Wetlands Educational Center.
- Parking permits are not required on University Holidays, when the University is closed, or not in session. Restricted parking stalls and improper parking violations are enforced.
- During special events, the University Police Department has the authority to close selected lots and parking stalls to regular permit holders and to collect fees for the use of parking facilities.
- A vehicle may be cited again for the same violation if the violation has not been corrected 24 hours from the timestamp on the warning/citation or the vehicle has moved to a different location within the 24-hour period and committed the same violation.
- All parking fines assessed to a vehicle are the responsibility of the FHSU permit holder, or the registered owner of the vehicle if no permit has been assigned to the vehicle.
- All traffic control signs and devices are in effect 24 hours, 7 days a week, unless otherwise stated.
- Parking is controlled by Zones 1 and 2, as defined within “Parking Permit Definitions” and by Restricted Parking Stalls. “Restricted Parking Stall” is defined as any parking stall or lot with stenciling, paint, markings, and/or signage that specifically identifies the type of parking stall or lot and/or time limitations imposed. Refer below for eligibility and specific definitions.
- The University Police Department controls parking by enforcing various parking zones, restricted parking stalls, permit display requirements, improper parking, and administrative violations. Each of these are defined within these regulations.
Parking Permit Definitions and Eligibility Requirements
- A parking permit for the current period will not be issued if the applicant has any unpaid parking fines.
- Permits may be purchased only for use by the purchaser and are non-transferable.
- Permits will be issued to an individual, not a vehicle, and grant the privilege of parking on University property to the permit holder and their spouse. Ownership of the permit remains with the University. A permit may be associated with multiple vehicles owned by and/or registered to the permit holder and their immediate family, and vehicles that the permit holder has been explicitly allowed to operate and control on a regular basis without the supervision of the registered owner.
- It is illegal to give false information on a permit application.
- Only one hanging permit will be sold per person per academic year. If the permit holder requires a different hanging permit than what they were issued, they must return the issued permit prior to the issuance of the new permit or make a report with the University Police Department that their issued permit was lost or stolen.
- Students required to complete a course at an off-site location more than 50 miles from Hays may apply for a “shared permit,” allowing several non-related students to use a single permit. Failure to register a “shared permit” and the vehicles associated will subject the permit holder and/or vehicle owners to fines.
Definitions and Fee Schedule
- Kansas Board of Regents Parking Permit – Granted permit.
- Issued by the Kansas Board of Regents.
- Grants parking privileges in any parking areas on campus, excluding handicapped stalls unless a handicapped placard is also displayed.
- Faculty/Staff – Granted permit.
- Any person engaged by FHSU for teaching, extension, research, administration, or service, or any person employed by a business connected with or employed by FHSU is eligible.
- Valid from August 1 through July 31 of the years identified on the permit.
- Grants parking privileges in any of the following restricted parking stalls on campus: Staff, Zone 1, and Zone 2, excluding handicapped stalls in those areas unless a handicapped placard is also displayed.
- Zone 1 - $25.00 per academic year or $5.00 for summer term only.
- Non-residential students (not residing/registered to reside in Residential Life housing) currently registered or pre-registered in one or more academic credit hours of classes through FHSU are eligible.
- Grants parking privileges in areas marked as Zone 1 and Zone 2 and the following time restricted areas (excluding handicapped stalls unless a handicapped placard is also displayed):
- College Dr., N. Campus Dr., S. Campus Dr., Park St., and Lyman Dr. north of the junction with Agnew Ln. between 7:00 AM and 4:30 PM on weekdays.
- Lots A2, A3, D, and Lot N north of the alley between 7:00 AM and 4:30 PM on weekdays.
- Lot Q between 7:00 AM and 4:30 PM on weekdays.
- Zone 2 - $13.00 per academic year or $5.00 for summer term only.
- Residential and non-residential students currently registered or pre-registered in one or more academic credit hours of classes through FHSU are eligible.
- Grants parking privileges in areas marked as Zone 2 and the following time restricted areas:
- Lots K, L, and M, Elm St. between Main St. and Lewis Dr., and the dirt portion of Lot J from 8:00 AM to 2:30 PM on weekdays.
- Lewis Dr. directly in front of the Hays Area Children’s Center (HACC) between 7:00 AM and 6:00 PM on weekdays.
- The interior island of Lot F1 and all of F2 prior to 7:00 AM and after 2:30 PM on weekdays, and 24 hours a day on weekends.
- Lot Q between 7:00 AM and 4:30 PM on weekdays and 24 hours a day on weekends.
- The following locations of Zone 2 are enforced 24 hours a day, 7 days a week while school is in session:
- Lots E, G, H1, H2, I, I2, J, and R.
- Lewis Dr. between Dwight Dr. and the island in front of the HACC.
- Dwight Dr., Custer Dr., Custer Circle, and Agnew Dr. in their entirety.
- Lyman Dr. south of Agnew Ln.
- Cycle - $10.00 per academic year.
- Motorcycles and mopeds with “Cycle” or “MBYC” license plates are eligible.
- Grants parking privileges in any marked Cycle stall.
- Motorcycles and mopeds may only park in Cycle stalls.
- Wooster Place Special Service - $13.00 per academic year or $5.00 for summer term only.
- Residents of Wooster Place Apts. who have primary custody of a child 8 years old or younger, and who have been verified by the Director of Residential Life or their designee no later than two (2) weeks prior to the beginning of each semester to meet this requirement are eligible.
- Grants parking privileges in the marked Special Service stalls in Lot I outside Wooster Place Apts. in addition to all other Zone 2 areas.
- This does not grant parking privileges in any other Special Service stalls around the FHSU campus.
- Foundation – Granted permit.
- Eligibility is determined by the Foundation and the University Police Department.
- Grants parking privileges in Staff, Zone 1, Zone 2, and visitor stalls, excluding handicapped stalls unless a handicapped placard is also displayed.
- Special Services – Granted permit.
- Individuals and/or businesses that frequently provide service to FHSU may apply with the University Police Department to determine their eligibility.
- Grants parking privileges in Service and Delivery, Staff, Zone 1, and Zone 2, excluding handicapped stalls unless a handicapped placard is also displayed.
- Honorary Faculty/Staff – Granted permit.
- Individuals who are retired faculty/staff of FHSU may apply with the University Police Department to determine their eligibility.
- Grants parking privileges in Staff, Zone 1, Zone 2, and visitor stalls, excluding handicapped stalls unless a handicapped placard is also displayed.
- Construction – Granted permit.
- Individuals and/or businesses working on an active construction site on FHSU property may apply with the University Police Department to determine their eligibility.
- Grants parking privileges in Construction stalls and the immediate area of their construction site. If necessary, Staff, Zone 1, and Zone 2 stalls can be used as overflow parking, excluding handicapped stalls unless a handicapped placard is also displayed.
- Temporary – Granted permit.
- Current permit holders who are temporarily unable to properly display their assigned permit or who have a temporary disability with written verification from a doctor may apply with the University Police Department to determine their eligibility.
- Grants parking privileges equivalent to their assigned permit, or in Zone 1 for those issued due to a temporary disability.
- Visitor – Granted permit.
- Individuals who are not currently registered or employed at FHSU and will be visiting campus for official business or to visit campus residents for a maximum of five (5) days are eligible.
- Other FHSU Departments may issue Visitor Permits by requesting them from the University Police Department ahead of time. The issuing department is required to maintain an accurate log of their issuance, to minimally include:
- The preprinted permit number,
- The name of the recipient, and phone number
- The vehicle registration number/tag number,
- The vehicle’s make, model and color
- The expiration date of the permit, and
- The name and department of the person issuing the permit.
- Grants parking privileges in accordance with Zone 1 restrictions.
- Visitors may utilize the marked Visitor stalls without a permit.
- Replacement - $5.00 per permit.
- Any lost or stolen permit must be reported to the University Police Department to relieve the purchaser of any further responsibility.
- Refunds requested after the first day of classes will only be considered by appeal.
Enforcement, Violations, Fines, Penalties, and Appeals
FHSU Police Officers are appointed by the Kansas Board of Regents and have the authority to halt motor vehicles, issue citations for violations, order vehicles impounded by towing, attach vehicle immobilization boots, and enforce traffic regulations. The University Police Department reserves the right to employ students to enforce parking regulations and issue parking citations.
Parking citations for zone violations or restricted stalls (excluding handicapped stalls or fire hydrant violations) as defined herein will be issued beginning the sixth (6th) day of classes each semester. Violations related to improper parking, handicapped stalls, and fire hydrants are subject to immediate citation.
The first (1st) parking violation of each semester (excluding handicapped stall or fire hydrant violations) will be issued as a warning. All subsequent violations within the same semester are subject to citations, fines, immobilization, and/or towing.
- Zone Violations (3)
- Zone 1 Violation ($45) – Parked in an unrestricted stall or lot within Zone 1 without a current and valid Zone 1, Faculty/Staff, Special Services, Honorary, Foundation, or Visitor parking permit during the times prescribed for that location.
- Zone 2 Violation ($45) – Parked in an unrestricted stall or lot within Zone 2 without a current and valid Zone 2, Zone 1, Faculty/Staff, Special Services, Honorary, Foundation, or Visitor parking permit during the times prescribed for that location.
- Other Zone Violation ($45) – Any other act that is deemed a zone violation.
- Restricted Stall Violations (26)
- 15-Minute Time Restriction ($15) – Parked in a “15-Min” stall for more than 15 minutes.
- HACC 15-Minute Time Restriction ($15) – Parked in a “15-Min” stall at the HACC for more than 15 minutes between 7:00 AM and 6:00 PM on weekdays.
- 30-Minute Time Restriction ($15) - Parked in a “30-Min” stall for more than 30 minutes.
- 2-Hour Visitor Time Restriction ($15) – Parked in a “2 Hr Visitor” stall for more than 2 hours or parked in a “2 Hr Visitor” stall while assigned a permit and therefore not being a visitor.
- Cart Restricted Stall ($15) – Parked in a “Cart” stall by any vehicle other than a FHSU-owned utility/golf cart.
- Clinic Restricted Stall ($15) – Parked in a “Clinic” stall without a current and valid Herndon Clinic visitor permit between 8:00 AM and 5:00 PM on weekdays.
- Compact Restricted Stall ($15) – Parked in a stall designated as “Compact Only” with a vehicle that a reasonable person would consider to be obstructing the view of pedestrians or motorists entering the roadway. “Compact Only” stalls shall only be utilized by small economy-sized vehicles or smaller.
- Construction Restricted Stall ($15) – Parked in a stall designated as “Const,” “Construction,” or “Construction Staff” without a current and valid Construction permit or vehicle badging displaying a company or contractor name/logo.
- Cycle Restricted Stall ($15) – Parked in a stall designated as “Cycle” without a current and valid Cycle permit during the times prescribed for that location, or by any vehicle other than a motorcycle or moped 24-hours a day.
- Emergency Vehicle ($75) – Parked in a stall, lot, or area designated as “Emergency Vehicle” by any vehicle not authorized in K.S.A. 8-2010.
- Fleet Parking ($15) – Parked in a stall or lot designated as “Fleet Parking” by any vehicle other than FHSU Motor Pool or FHSU Athletic Department vehicles. FHSU Motor Pool and Athletic Department vehicles do not require permits.
- Handicapped ($100) – Parked in a stall or lot designated as “Handicapped” without a current and valid official state-issued handicapped or disabilities placard or license plate properly displayed (K.S.A. 8-161; 8-1,129).
- Redacted – Meter Time Restriction
- No Parking – Loading/Unloading ($15) – Parked in an area designated as “No Parking: Loading/Unloading” while not engaged in loading or unloading of items/people.
- President Restricted Stall ($45) – Parked in a stall designated as “President” by any vehicle other than those of the FHSU President or their designee.
- Provost Restricted Stall ($45) - Parked in a stall designated as “Provost” by any vehicle other than those of the FHSU Provost or their designee.
- Res Life Yellow Curb Area ($15) – Parked in the yellow curb area in Lot G near the center entrance to McMindes Hall or along the curb in Lot I directly south of Victor E. Village between the times of 6:00 AM and 4:00 PM.
- Res Life Time Restriction Area ($15) - Parked in the yellow curb area in Lot G near the center entrance to McMindes Hall or along the curb in Lot I directly south of Victor E. Village for more than 30 minutes between 4:00 PM and 6:00 AM.
- Service and Delivery Stall ($15) – Parked in a stall or area designated as “Service/Delivery” by any vehicle other than a delivery service vehicle, an FHSU service/maintenance vehicle, or a vehicle displaying a current and valid Special Services permit during the times prescribed for that location.
- Staff Restricted Stall ($45) – Parked in a stall or lot designated as “Staff” without a current and valid Faculty/Staff, Special Services, Honorary, or Foundation permit between 7:00 AM and 4:30 PM on weekdays (unless otherwise posted).
- Staff Restricted Lot/Area ($45) – Parked in a stall or area designated by signage as “Staff Parking Only” without a current and valid Faculty/Staff, Special Services, Honorary, or Foundation permit 24-hours a day.
- 24-Hour Staff Stall ($45) – Parked in a stall or area designated by signage as “24-Hour Staff” without a current and valid Faculty/Staff, Special Services, Honorary, or Foundation permit 24-hours a day.
- Visitor Restricted Stall ($15) – Parked in a stall or area designated as “Visitor” without a current and valid Visitor permit or while being assigned a permit and therefore not being a visitor.
- Special Service: Restricted ($45) – Parked in a stall or area designated as “Special Services” without a current and valid Special Services permit between 7:00 AM and 4:30 PM on weekdays (unless otherwise posted).
- Special Service Res Life ($45) – Parked in a Wooster Place Apts. “Special Service” stall without a current and valid Wooster Place Special Service permit 24-hours a day.
- Other Restriction Violations ($15) – Any other act deemed a restricted parking violation.
- Improper Permit Display Violations (7)
- Blocked View ($15) – Either or both sides of the permit are partially or fully obstructed from view by other items hanging within the vehicle, window tint, mutilation or alteration of the permit, or by being positioned to be not fully visible. This does not include when using a sun protector, provided the permit is kept on the side nearest the windshield.
- Multiple Permits ($15) – Displaying more than one permit of any kind, including FHSU parking permits. This does not include the display of a handicapped placard.
- Hanging Parking Permit ($15) – Failure to properly display a hanging permit, which must be hung from the interior rearview mirror. In the absence of a rearview mirror or when the mirror design prevents proper display, it is acceptable to suspend the permit in the approximate area of a rearview mirror by other means (string, rubber band, etc.), tape the permit to the windshield in the approximate area of a rearview mirror, or place the permit on the dash directly in front of the driver’s seat with the front of the permit fully displayed.
- Cycle Permit Display ($15) – Failure to properly display a Cycle permit, which must be adhered to the front left fork.
- Construction Permit Display ($15) – Failure to properly display a Construction permit, which must be adhered to the rear window in the lower left corner.
- Honorary Permit Display ($15) – Failure to properly display an Honorary permit, which must be adhered to the rear window in the lower left corner.
- Other Improper Permit Display ($15) – Any other act deemed a violation of a permit display.
- Improper Parking Violations (12)
- Parked On/Over Lines ($15) – Parked with any portion of the vehicle on or over the lines of the stall.
- Parallel/Angled Stalls ($15) – Parked facing in opposition to the flow of traffic in the driving lane immediately adjacent to the parking stall.
- Curb Stall Parking ($15) – Parked with the rear of the vehicle against a curb or curb block. This does not apply to motorcycles or mopeds.
- Parked Too Far from the Curb ($15) – Parked in a parallel stall with one or both curbside wheels more than 12 inches from the curb.
- Parked Outside a Stall ($15) – Parked in any area where no stall exists or where no explicit permission to park has been provided, including but not limited to, unlined areas, areas immediately adjacent to stalls which are only lined on one end/side, and areas without curbs or curb blocks.
- Parked in No Parking ($15) – Parked in a stall or area designated as “No Parking” by signage, markings, paint, or other indicators.
- Blocking a Crosswalk or Curb Cut ($15) – Parked where any portion of the vehicle interferes with or blocks any portion of a pedestrian crosswalk or handicap curb cut.
- Parked on Grass or Sidewalk ($15) – Parked on grass or sidewalks, other than when explicitly directed to by law enforcement or parking personnel.
- Parked Blocking Traffic ($75) – Parked in any manner which blocks or restricts the safe or normal flow of traffic, other than when explicitly directed to by law enforcement or parking personnel.
- Blocking Fire Hydrant ($75) – Parked within 15 feet of a fire hydrant, within a stall or area designated as “No Parking” due to the proximity of a fire hydrant, or in any manner which obstructs or interferes with direct access to the fire hydrant. Any damages caused to a vehicle which is interfering with fire hydrant access during the utilization of said fire hydrant are the sole responsibility of the permit holder and/or registered owner.
- Other Improper Parking Violation ($15) – Any other act deemed an improperly parked vehicle under university, municipal, county, or state expectations.
- Bicycle Violations ($25) – Parking or storing a bicycle at any location other than the provided bicycle racks. Any bicycle found parked or stored in an unauthorized location or secured to anything other than a provided bicycle rack is subject to removal and impound at the owner’s expense, to include the cutting of locks or chains securing the bicycle. A $25 release fee shall be assessed to the owner.
- Administrative Violations (6)
- Illegal Permit ($75) – Using or possessing an illegal, forged, or otherwise unauthorized parking permit.
- Unauthorized Permit Use ($75) – Using or possessing a parking permit assigned to someone else, other than as prescribed elsewhere in these regulations.
- Ineligible Permit Holder ($45) – Failure to surrender a parking permit to the University Police Department after becoming ineligible to possess or use the permit.
- Illegal Signage ($75) – Posting, removing, or altering any traffic signage or markings on FHSU property without the explicit approval of the University Parking Committee.
- Other Administrative Violation ($75) – Any other act deemed a violation of the regulations governing the acquisition, use, possession, modification, or return of FHSU parking permits, signage, and equipment.
- Boot Fee ($25) – If an immobilization device (boot) has been applied to a vehicle by the University Police Department, a $25 fee shall be assessed to the permit holder and/or registered owner for the removal of the boot. Operation of a vehicle with a boot attached will likely cause significant damage to the vehicle. Any damage received during the operation of a vehicle with a boot attached is the sole responsibility of the permit holder and/or registered owner, including damage to the immobilized vehicle, boot, roadway, or other vehicles.
Payment of Fines
Parking fines incurred by students can be paid through their Workday portal or at the Student Fiscal Services office in Picken Hall, room 317. All payments towards the student’s outstanding balance are applied to the charges in the order that they were added to the student’s account, which results in most payments being applied to tuition and housing prior to parking fines. To avoid late fees for unpaid parking fines, students with an outstanding balance should contact Student Fiscal Services and specifically request the payment be applied to the parking fines. If additional costs are reasonably incurred in the process of collecting any amount due, including attorney or collection agency fees, those will be charged to the student. A $25.00 administrative fee is assessed each time a payment due date is missed until the balance has been satisfied.
Parking fines incurred by faculty, staff, visitors, or others who do not have access to the Workday portal must be paid at the University Police Department in Custer Hall, room 112. All payments made at the University Police Department must be by cash or check.
Other Penalties
- Students with outstanding fees or fines will not be permitted to pre-enroll, drop, or add courses or receive a transcript.
- Faculty/Staff permits must be returned to the University Police Department and any outstanding fees or fines paid upon termination of employment. Failure to comply may result in legal action.
- Any vehicle operator with 4 or more unpaid parking fines will be notified by certified mail of the status of their account and that the fines must be paid within 14 days of receipt of the letter. Failure to pay the fines or establish a payment plan within the 14-day period will result in the vehicle being towed off campus or an immobilization boot being attached to a wheel of the vehicle, both at the owner’s expense.
- Vehicles may be removed from FHSU property if left standing or parked in violation of campus regulation or state laws governing vehicles. Any tow-off will be at the owner’s expense.
- Delinquent accounts may be forwarded to a collection agency and/or the Set-Off program as created in K.S.A. 75-6201.
- Abandoned property will be sold by the University Police Department if not claimed and removed.
Appeals
The University Parking Committee shall have immediate jurisdiction over issues dealing with parking at FHSU and shall have the authority to assess fines as necessary. The University Parking Committee is composed of students, faculty, and staff, and is part of the judiciary branch of the Student Government Association. Appeals must be submitted within 14 days of the citation date, using the Appeals Form located at the bottom of the page at University Police Department Parking Permits or by calling 785-628-5304. After submitting an appeal, those who wish to may arrange to make a personal appearance before the University Parking Committee. Failure to submit an appeal within the 14-day period will be considered prima facie evidence that the violation will not be appealed.
It is recommended that the parking fine be paid even if an appeal is submitted, to prevent accruing late fees. In the event the appeal is granted, the fine amount for the violation(s) will be reimbursed, but any late fees that were incurred may not be reimbursed.
Other Expectations and Information
- Any accident, collision, or damage involving a vehicle that occurs on FHSU property must be reported to the University Police Department immediately at 785-628-5304 or by calling 785-625-1011. In the event of an emergency or injury, call 911.
- All state and municipal driving laws are in effect on FHSU property.
- All vehicles operated on FHSU property should be driven with caution and with due regard for weather, pedestrian, and vehicle traffic conditions.
- The speed limit is 20 MPH on all FHSU streets and 15 MPH in parking lots.
- All motorized vehicles, excluding motorized wheelchairs, shall not be operated on the grass, sidewalks, or pedestrian walkways.
- When so declared by the President of the University or the designated representative, all campus streets and drives are designated as snow emergency routes. Vehicles blocking snow routes are subject to fines and/or towing at the owner’s expense.
