Reproductions and Licensing
Reproductions
All requests for the reproduction of materials held in Tebo Library Special Collections & University Archives (SCUA) are reviewed by SCUA personnel. Requests may be denied or limited based on factors such as copyright compliance, donor restrictions, or the condition of the item. The recipient of the reproductions or files downloaded directly from the Scholars Repository’s Archives Online and FHSU Digital Collections may use them only for research, teaching, or private study. Recipients may not make them for, or donate or sell them to, other repositories. Further, when the reproduction and use of materials held by the Tebo Library Special Collections & University Archives, including those images downloaded from the Scholars Repository’s Archives Online and FHSU Digital Collections, exceed the allowances made under Fair Use, reproductions are subject to the terms and conditions established in the Tebo Library Special Collections & University Archives Reproductions and Permissions policy.
Notice Warning Concerning Copyright Restrictions
The copyright law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted material.
Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specified conditions is that the photocopy or reproduction is not to be "used for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of "fair use," that user may be liable for copyright infringement.
This institution reserves the right to refuse to accept a copying order if, in its judgment, fulfillment of the order would involve violation of copyright law.
Reproductions Created by Patrons
Visitors to the Tebo Library Special Collections & University Archives and its Larry & Lyn Fenwick Reading Room are generally permitted, in accordance with posted copyright regulations, to photograph its materials though some SCUA materials have already been digitized and available in the FHSU Scholars Repository’s Archives Online and FHSU Digital Collections. When visitors wish to photograph materials, they must adhere to the guidelines contained in the handout provided by SCUA personnel which include that:
- Cameras may only be used without flash or tripod. Please stand on the floor or remain seated to photograph the material. If you need assistance, consult the Fenwick Reading Room attendant.
Please be respectful of other researchers’ privacy by only photographing materials.
Reproductions Created by SCUA Personnel
Visitors to the Fenwick Reading Room and remote researchers may also request that SCUA personnel provide reproductions of materials. Please see the posted Reproductions Fees schedule below for more information.
Using Copyrighted Materials in Commercial / For-Profit Works
In many instances, Fort Hays State University and Tebo Library Special Collections & University Archives claim only physical ownership of some materials. Patrons wishing to publish, quote, broadcast, or exhibit this material must assume all responsibility for identifying and satisfying any claimants of copyright.
If you intend to use SCUA materials which are subject to copyright in for-profit or commercial projects, you must first obtain permissions from SCUA personnel or, if the work’s copyright is not held by Fort Hays State University, the patron must seek permission from the current copyright holder. The patron agrees to assume full responsibility and any attendant liability for complying with U.S. copyright laws and other rights of third parties.
All researchers intending to use SCUA materials in excess of Fair Use allowances must complete an Application for Permission to Publish, Quote, Broadcast, or Exhibit Items from Tebo Library Special Collections & University Archives and Tebo Library Digital Collections. SCUA personnel reviews all applications and will work with applicants in determining affiliate status and applicable fees.

Licensing Fees:
Licensing fees apply to any SCUA materials used in excess of Fair Use and whose copyright is held by Fort Hays State University. As licensing fees vary based on the nature of the project, please review the schedule provided in the Application for Permission for Permission to Publish, Quote, Broadcast, or Exhibit Items from Tebo Library Special Collections & University Archives and Tebo Library Digital Collections.
Waivers:
Licensing fees for images or excerpts are waived for FHSU affiliates.
